HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.38219 of 2012 ORDER:

The order under challenge in this Writ Petition is the order of suspension dated 01.12.2012. An interim order was passed, in W.P.M.P.No.48475 of 2012 dated 24.06.2013, suspending the order of suspension. On the ground that the respondents had not complied with the order, the petitioner appears to have initiated proceedings under the Contempt of Courts Act.

Sri T.Nagarjuna Reddy, Learned Counsel for the 1st respondent, would submit that the petitioner was appointed as the Secretary of the Madanapalle Primary Agricultural Co-operative Society on 01.05.2013, even before the interim order was passed by this Court. As the petitioner is now employed in another Society, the cause in the Writ Petition does not survive, and the Writ Petition has become infructuous. Suffice it to make it clear that, for the period prior to his being employed in the Madanapalli Primary Agricultural Co-operative Society, it is open to the petitioner to agitate his claim, for payment of subsistence allowance, in appropriate legal proceedings, if it has not been paid.

With the aforesaid observations, the Writ Petition is dismissed. The Miscellaneous Petitions pending, if any, shall also stand dismissed. No order as to costs.
