THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE K.LAKSHMAN WRI T PETI TI ON No.32401 OF 2018 and C.E.A.No.172 of 2018 COMMON ORDER: (per SK,J) Ms.Rubaina S. Khatoon, learned counsel for the petitioners in W.P.No.32401 of 2018 and the appellants in C.E.A.No.172 of 2018, addressed letter dated 09.09.2019 to the Registry stating that her clients wish to avail the benefit of a scheme floated by the Central Government and that they may be permitted to withdraw these cases reserving liberty to them to file fresh cases in case a new cause of action arises. 2.
Accepting the request, the writ petition and the appeal are dismissed as withdrawn with the liberty aforestated. The bank guarantee furnished by the petitioners/appellants pursuant to the interim order dated 26.09.2018 passed in the appeal shall abide by the result of their application under the scheme.
Pending miscellaneous petitions, if any in both cases, shall also stand dismissed. No order as to costs.
