HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.5611 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Civil Supplies.

2. This writ petition is filed seeking writ of Mandamus declaring the action of the 3rd respondent in passing orders dated 05.02.2015 suspending the petitioner from Fair Price Shop No.30 of Marempalli Village, Gummghatta Mandal, Kalyandurg Revenue Division, Ananthapuram District, as illegal and arbitrary.

3. It is submitted by the learned counsel appearing for the petitioner that the petitioner submitted demand drafts for the months of October 2014 onwards, instead of it, the demand drafts were obtained from the neighbouring Fair Price shop dealer and the stocks were released to him. When the action of the Tahsildar was questioned, a show cause notice was issued making false allegations and subsequently, impugned suspension order was passed against the petitioner, even though there were no irregularities. Learned Government Pleader for Civil supplies submits that there are many allegations against the petitioner and the order being one of the suspension pending enquiry, need not be interfered with.

Considering the submissions made by both sides and following the judgment of the Division Bench of this Court passed in WP MP No.343 of 2015 in WA No.118 of 2015, this writ petition is disposed of directing the 3rd respondent-the Revenue Divisional Officer, Kalyandurg, Ananthapuram District, to conduct enquiry against the petitioner and pass final orders within a period of eight (8) weeks from the date of receipt of a copy of this order. Miscellaneous applications, if any, shall stand closed. No order as to costs.
