THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5849 OF 2015 ORDER:
This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/accused seeking grant of anticipatory bail in connection with crime No.263 of 2015 on the file of the P.S., Maheswaram, registered for the offence under Section 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Heard and perused the records.
The learned counsel for the petitioner submits that the case is registered in the month of November, 2014. He further submits that the petitioner is a law abiding citizen, he is ready to cooperate with the investigating agency and he is also ready to comply with any of the conditions that may be imposed on him while granting anticipatory bail. He further submits that the petitioner is issued non-bailable warrant by the Court below.
Having regard to the facts and circumstances of the case, the petitioner/accused is directed to surrender before the Court concerned and file an application for recalling NBW issued against him before the Magistrate concerned within a period of fifteen days from today and on such surrender and filing of such application, the trial Court is directed to recall the NBW issued against the petitioner/accused on the same day on condition of the petitioner executing a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for a like sum to the satisfaction of the said Magistrate with an undertaking for his appearance before the Court concerned at the time of trial.
