THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No.2092 OF 2016 O R D E R:

This contempt case is filed alleging non-implementation of the order, dated 29.06.2016, passed by this Court in WPMP No. 25412 of 2016 in W.P.No.20728 of 2016.

By the aforesaid order, this Court passed the following order:

"In view of the orders passed by this Court in similar cases in WPMP No.16474 of 2016 in W.P.No.13160 of 2016, there shall be an interim suspension as prayed for. Further, it is made clear that the petitioner is entitled to pay the procurement tariff as being paid by it at present." Though learned counsel for the petitioner submits that the petitioner is paying the tariff as applicable prior to the passing of the aforesaid order and arrears have also been paid, learned counsel for the respondent submits that the amounts which are due and payable by the petitioner are much more than the amounts paid by him.

On due consideration of the respective submissions, this Court finds that the order, dated 29.06.2016, has been complied with so far as the admitted dues are concerned. As there is a dispute with respect to other amounts, the same would have to be considered at the time of hearing of the writ petition. The contempt case is accordingly closed.

Consequently, miscellaneous applications, if any shall stand closed.
