HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 33217 of 2018 ORDER:

1) Heard learned counsel for the petitioners and Government Pleader for Revenue (AP). With consent of both the parties, the writ petition being heard at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the second respondent in not deciding the petitioners' appeal and stay petition filed against the order in Ref.No.A/ 21/ 2018, dated 01.05.2018, passed by the third respondent, thereby resuming the petitioners' land admeasuring Ac.5.00 cents in Sy.No.1149 situated at Thippayapalli Revenue Village of Pullampeta Mandal, YSR Kadapa District, as illegal, irregular and irrational. 3) The grievance of the petitioners is that though the appeal was filed on 19.06.

2018, till date no orders are passed either in the appeal or in the stay application filed along with the appeal. 4) The Government Pleader for Revenue (AP) would submit that if reasonable time of atleast 3 to five months is given, the authorities shall pass appropriate orders in the appeal. 5) Without going into the merits of the case and having regard to the submissions made, the present writ petition is disposed of, directing the second respondent to dispose of the appeal filed by the petitioners, against the order of the third respondent in Ref.A/ 21/ 2018, dated 01.05.

including the petitioners, in accordance with law, as expeditiously as possible, preferably, within a period of three to five months from the date of receipt of a copy of the order. However, if an application for stay is made and pending consideration, the same shall be dealt with in accordance with law, preferably, within a period of six weeks from the date of receipt of a copy of the order. There shall be no order as to costs.

6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
