THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.21149 OF 2014 ORDER:

Heard the learned counsel for the petitioner. The prayer sought for in the writ petition is as under: "to issue a writ of mandamus declaring the action of the respondents 2 and 3 in registering FIR as per representations dated 07.06.2014 & legal notice dated 30.06.2014 against the creditors and to investigate the case, as illegal, arbitrary, unsustainable and violative of Article 19 and 21 of Constitution of India and consequently, direct the respondents 2 and 3 to register the FIR and conduct investigation."

During the course of hearing, the learned Government Pleader appearing for the respondents 1 to 3, informed the Court that the Station House Officer, Railway Kodur, YSR Kadapa District-3rd respondent herein has not received any complaint from the petitioner and therefore, no crime has been registered. Further, a perusal of the complaint enclosed with the material papers will not disclose any cause of action since no allegation is made in the complaint except stating that protection may be given to the petitioner and her family members. As such this Court is not inclined to entertain the writ petition.

Accordingly, the Writ Petition is dismissed. No costs. Pending miscellaneous petitions, if any, shall stand closed. ___________________ P.KESHAVA RAO,J 31st OCTOBER 2018.
