Heard the learned counsel for the petitioners and also the learned Public Prosecutor representing the 1st respondent-state before ordering notice to the 2nd respondent and perused the quash petition averments and the First Information Report. On perusal of the record no way enables the Court to admit or interdict the investigation. Needless to say if at all any arrest is required, the police shall follow Section 41-A of CrPC, and also as held in Arnesh Kumar Vs. State of Bihar1.

Accordingly and in the result, the Criminal Petition is disposed of without prejudice to any future defence of the petitioners.
