THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION NO.37619 OF 2012 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner to declare the action of respondents 1 to 4 in not issuing a notification for appointment of the Trust Board for the fifth respondent-Temple for its management, as illegal, arbitrary and contrary to the provisions of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987 and consequently, to direct respondents 1 to 4 to issue notification for appointment of the Trust Board for the fifth respondent-Temple.
At the hearing, learned counsel for the petitioner, while reiterating the contentions urged in the affidavit filed in support of the relief claimed, submits that, as on today no notification was issued and that the Writ Petition may be disposed of with appropriate directions. Learned Standing Counsel for the fifth respondent-Temple endorses the said submissions.
Having regard to the submissions made, the Writ Petition is disposed of directing the respondents 1 to 4 to follow the procedure established by law and do the needful in the matter of appointment of the Trust Board for the fifth respondent-Temple, as expeditiously as possible, preferably within three (3) months from the date of receipt of a copy of this order.
