HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.42998 of 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the inaction of respondents in considering the representation of the petitioner dated 28.10.2016 for refund of stamp duty, transfer duty and registration fee, as illegal and arbitrary.

Heard the learned counsel for the petitioner as well as the learned Government Pleader for Stamps and Registration for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.

The limited grievance of the petitioner in this writ petition is that though he submitted an application on 28.10.2016 seeking refund of stamp duty, transfer duty and registration fee, till date no orders are passed.

Learned GP would submit that the 4th respondent may be directed to dispose of the application made by the petitioner, in accordance with law.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the 4th respondent-The District Registrar, to deal with the representation of the petitioner dated 28.10.2016 seeking refund of stamp duty, transfer duty and registration fee vide pending document No.P-42 of 2016 in respect of plot bearing No.B-548 admeasuring 500 Sq.yards forming part of Sy.Nos.94 to 97 and Part of 189 situated at Kondapur Village,

Serlingampally Mandal, Ranga Reddy District, and pass necessary orders thereon, in accordance with law, after hearing the petitioner, if necessary, as early as possible, preferably within a period of four weeks from the date of receipt of a copy of this order. Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
