HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.9808 of 2018 ORDER :

This criminal petition filed under Section 438 Cr.P.C. by the petitioner/sole accused in Crime No.221 of 2018 of Chintalapudi Police Station, West Godavari District, registered for the offences punishable under Sections 420 and 304-II IPC. 2.

The petitioner, who went unsuccessful in seeking anticipatory bail in Crl.M.P.No.914 of 2018, dated 28.08.2018, before the learned Sessions Judge, in seeking anticipatory bail moved this Court by present application.

Heard learned counsel for the petitioner and learned Public Prosecutor, representing the State, who opposed the same, and perused the First Information Report, bail application averments and dismissal order of the learned Sessions Judge and the case diary file. 4.

A perusal of the case record clearly shows that the petitioner administered the injunctions that resulted death of the deceased. Having regard to the above, there is prima facie accusation under Section 304-II IPC, thereby, the petitioner is not entitled to the concession of anticipatory bail.
