ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioner/A4 seeking to quash the proceedings in C.C.No.1282 of 2014 (old CC No.9 of 2012) on the file of II Additional Munisf Magistrate, Ongole, registered for the offences punishable under Sections 498-A, 420, 506 r/w Sec.34 IPC and under Sections 3 and 4 of Dowry Prohibition Act, against her.

2. Heard and perused the material on record.

3. It is alleged in the charge sheet that A1, at the instigation of A2 to A5, used to harass his wife i.e., 2nd respondent herein, mentally and physically by demanding additional dowry.

4. Learned counsel for the petitioner/A4 submits that since NBW is pending against the petitioner, the same may be recalled.

5. Issuance of NBW is to secure the attendance of the petitioner before the trial Court. As the petitioner expressed her willingness to appear before the trial Court regularly, the NBW issued against her can be recalled.

6. The Criminal Petition is disposed of, with the following direction;

The petitioner/A4 is directed to appear before the trial Court within 10 days from today and file an application under Section 70(2) Cr.P.C., for recalling of NBW pending against her. On filing such an application, the trial Court shall consider the same on usual terms in accordance with law. Till such time, the warrant issued against the petitioner is hereby suspended. The petitioner herein is further directed to appear before the trial Court on each and every date of adjournment.

Miscellaneous petitions, if any, pending in this petition shall stand disposed of.
