Battu Sailoo, v. Fisheries Development Officer,
THE HON'BLE SRI JUSTICE C.V. NAGARJUNA REDDY WRIT PETITION NO.18073 OF 2012 DATED:30-7-2015 Between:
Battu Sailoo ... Petitioner And Fisheries Development Officer Arasapally Nizamabad Nizamabad District and another ... Respondents ... Respondents COUNSEL FOR THE PETITIONER: None appeared COUNSEL FOR THE RESPONDENTS: G.P. for Fisheries (TS)
THE COURT MADE THE FOLLOWING:
ORDER:
This writ petition is filed for the following substantive relief: "...to issue a Writ, order, direction more particularly one in the nature of Writ of Mandamus declaring that the action of the respondents in issuing impugned auction notice dated 13.06.2012 is illegal, arbitrary, unlawful and unconstitutional and consequently set aside the same and direct the respondents not to interfere in "Kadi Cheruvu" water tank." At the hearing, there is no representation for the petitioner. A perusal of the proceedings sheet shows that on 21.6.2012 this Court has placed on record the fact that the auction scheduled on 18.6.2012 under the impugned auction notice did not take place. In view of the same, the cause in the writ petition does not survive for adjudication.
Hence, the writ petition is dismissed as infructuous. As a sequel to dismissal of the writ petition, interim order dt.21.6.2012 shall stand vacated and W.P.M.P. No.23158 of 2012 and W.V.M.P. No.3526 of 2012 shall stand disposed of as infructuous. _______________________ C.V. NAGARJUNA REDDY, J 30-7-2015 bnr
