THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY W.P.M.P. No.28822 of 2016 AND WRIT PETITION No.41486 of 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India to issue a writ of Mandamus declaring the impugned action of the respondent in not awarding the Ph.Ds to the petitioners by conducting Viva-Voce and other procedures in spite of completion of the research and study under the guide and submission of thesis way back in the years 2009 to 13, without any justifiable reasons as illegal, arbitrary, void abinitio and violative of Articles 14 & 21 of Constitution of India besides violative of due procedure of law and violative of principles of natural justice and consequently direct the respondent to award Ph.Ds to the petitioners by conducting Viva-Voce within a period of 30 days by following the due procedures contemplated under the rules.
2. W.P.M.P. No.28822 of 2016 is filed by the writ petitioner Nos.1, 3 and 4 seeking permission of this court to withdraw the writ petition. Permission is granted. A perusal of the record clearly reveals that the writ petition in respect of petitioner No.2 was dismissed as withdrawn by the order dated 01.6.2016 in WPMP No.16824 of 2016.
3. Accordingly, W.P.M.P. No.28822 of 2016 is ordered and the writ petition is dismissed as withdrawn. Miscellaneous petitions if any pending in this writ petition shall stand closed. __________________________ (T.SUNIL CHOWDARY, J) July 20, 2016.
