HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.1207 OF 2017 ORDER:
The request in the present petition is to relax one of the conditions imposed by the learned II-Additional Metropolitan Sessions Judge, Hyderabad, while granting anticipatory bail to the petitioner - accused No.2, on 19.01.2017 in Crl.M.P.No.75 of 2017 in Crime No.462 of 2012 of Moghalpura Police Station, Hyderabad. 2.
The condition sought to be relaxed is to surrender the passport of the petitioner before the VIII-Additional Chief Metropolitan Magistrate, Hyderabad. However, the other condition is to execute a personal bond of Rs.10,000/- with two sureties for the like sum each to the satisfaction of the learned Magistrate. 3.
Learned counsel for the petitioner would submit that the petitioner, being an activist has to travel various places and if the passport is surrendered, it would be difficult to him to attend the meetings abroad and, therefore, requested to quash that condition. 4.
Heard learned Additional Public Prosecutor for the State of Telangana.

The condition imposed while granting anticipatory bail to the petitioner cannot be faulted. Even otherwise, when looked at the nature of the offences punishable under Section 353 and 506 IPC alleged to have been committed by the petitioner, the complaint in fact was lodged by a Head Constable, who was obstructed while discharging his official duties, a copy of which, is available at page 15
of the material papers, certainly, the request of the petitioner is not just and reasonable.

Accordingly, the criminal petition is dismissed at admission stage.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petition stand closed.
