THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.13312 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, the petitioner herein prays that this Hon'ble Court may be pleased to issue writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd Respondent in filing charge sheet/final report dated 30.12.2014 in Crime No.228 dated 10.03.2014 referring the case as civil nature, before the XXI Metropolitan Magistrate, Cyberabad, as completely illegal, arbitrary, unjust, unreasonable and consequently direct the 3rd respondent or CID of Telangana or CBI to investigate the case and interrogate 4th respondent and his family members, do proper and detailed investigation in the case relating to the missing person Mr.

Kishan Ram Devasi to trace him and bring the culprits if any, to justice and award costs and pass such other or further orders as are deemed fit and proper in the circumstances of the above case." If the petitioner has any grievance with regard to the final report dated 30.12.2014 filed by the police authorities in relation to Crime No.228 of 2014 on the file of Alwal Police Station referring the case as civil in nature, statutory remedies are available to him before the competent criminal Court. Without taking recourse to such efficacious remedies, it is not open to the petitioner to directly approach this Court.

The writ petition is accordingly disposed of permitting the petitioner to take recourse to appropriate legal remedies in accordance with law, as regards his grievance with regard to the final report filed in relation to Crime No.228 of 2014.
