THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.22989 of 2012 ORDER:

This Writ Petition was filed challenging the action of respondent Nos.1 to 4 in considering the request of the fifth respondent for shifting of Bar & Restaurant from D.No.27-14-50, Rajagopalchari Street, Governerpet, Vijayawada, to D.No.48-16-39/3, Plot No.51, R.S.No.372, Kamineninagar, Gunadala, Vijayawada.

The petitioner was a successful license holder for the sale of Indian made foreign liquor and foreign liquor in respect of shop No.A, Prohibition & Excise Station, Vijayawada, for the period from 01.07.2012 to 30.06.2013. He submitted a representation on 12.07.2012 not to allow any transfer of bar licence to the locality where he has been doing business. In spite of the same, when the application of the fifth respondent was considered for transfer, the present Writ Petition was filed.

The licence of the fifth respondent was for the period 2012 and 2013 and, as stated above, the licence of the petitioner was also for the same period.

In view of the expiry of the period of licence of the petitioner as well as the fifth respondent, nothing survives for adjudication in the present Writ Petition.

The Writ Petition is, therefore, dismissed as infructuous. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
