HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL REVISION CASE No.2422 of 2016 ORDER:
The present revision is filed under Sections 397 and 401 of the Code of Criminal Procedure (Cr.P.C.), questioning the order dated 08.08.2016 passed in Crl.M.P.No.3912 of 2015 in C.C.No.306 of 2012 on the file of II Additional Judicial Magistrate of First Class, Tirupathi, wherein and where under the petition filed to discharge the accused was rejected.
Though the present revision is filed questioning the order of discharge, learned counsel for the petitioner restricts his prayer seeking dispensation of the presence of petitioner, during the course of the trial. The learned Additional Public Prosecutor submits that since there is no dispute with regard to the identity, his presence may not be necessary on every date of adjournment. Having regard to the facts and circumstances of the case and since there is no dispute with regard to the identity of the petitioner, his presence in C.C.No.306 of 2012 on the file of the II Additional Judicial Magistrate of First Class, Tirupathi, is hereby dispensed with except on the dates when his presence is specifically required by the Court.
With the above direction, the Criminal Revision Case is disposed of.
