HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 33420 of 2018 ORDER:

1) Heard learned counsel for the petitioner, learned Government Pleader for Revenue and learned Standing Counsel for Gram Panchayath. With their consent, the writ petition is disposed of at the admission stage itself.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondents in not granting assignment pattas in terms of G.O.Ms.No.1 Scheduled Caste Development (SCP) Department, dated 26.07.2014, admeasuring Acs.03.00 of agriculture lands to the petitioners situated at Peddamarur village, Chinnambavi mandal, Wanaparthy District, as illegal and arbitrary.

3) Though various grounds are raised, learned counsel for the petitioners submits that the representation made by the petitioners dated 20.08.2018, seeking assignment of land in terms of G.O.Ms.No.1 Scheduled Caste Development (SCP) Department, dated 26.07.2014, may be directed to be considered in accordance with law. He placed reliance of the earlier order passed in W.P.No.40910 of 2016, wherein a direction was given to the District Collector, Wanaparthy, to consider the representation made by the

petitioner therein for assignment of lands, in accordance with law, subject to their eligibility.

4) Learned Government Pleader for Revenue would submit that allotment of assignment of land would be subject to various stands and conditions, more particularly with regard to availability of the land for assignment.

5) Having regard to the above, the writ petition is disposed of directing the respondent - authorities to deal with the representation dated 20.08.2018, in accordance with law, keeping in view the objections raised by the learned Government Pleader and by the learned Standing Counsel for Gram Panchayath, at the earliest. 6) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
