HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY Writ Petition No. 7873 of 2010 ORDER :
This writ petition is filed seeking writ of mandamus declaring the action of the 2nd respondent in issuing impugned notification in Ref.No.C2/848/2010, dated 27.03.2010 putting the shops 1 to 4 situated in Sri Ammavari Neppala Mandapam shown as item No.1 in impugned notification, for public auction without considering the representation of the petitioners dated 06.02.2010 as illegal and arbitrary and consequently to direct the respondents to drop all further proceedings including dispossession of the petitioners in respect of subject shops. This Court, while admitting the writ petition on 09.04.2010, granted interim order in W.P.M.P.No.10122 of 2010 stating that auction may go on and be finalized, as proposed by impugned notification, on 12.04.2010 and any such finalization shall be subject to further orders in the above WPMP.
Heard Sri Ambati Srikanth Reddy, learned Standing Counsel for the 2nd respondent, who states that due to efflux of time, the period mentioned in the impugned notification has expired as it was issued for auctioning the subject shops from 01.05.2010 to 30.04.2013, as such, the cause in the writ petition does not survive for consideration. Recording the submission of the learned Standing Counsel for the 2nd respondent and also in view of the interim orders granted on 09.04.2010 in WPMP No.10122 of 2010, this writ petition is dismissed as infructuous.
There shall be no order as to costs. As a sequel thereto, miscellaneous applications, if any pending in this Writ Petition, shall stand dismissed.
