HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO TRANSFER CRIMINAL PETITION No.108 of 2017 ORDER :

Heard both sides.

The main contention is that the 1st respondent is a practicing advocate in Srikakulam being member of the bar. To avoid unpleasantness, to sub-serve the ends of justice and by considering the convenience of both parties, which is one of the requirements, M.C.No.24 of 2016 on the file of the III Additional District Judgecum-Family Court, Srikakulam, is transferred to Judge, Family Court, Vizianagaram, to proceed according to law. Needless to say, if the parties representing through advocates, the Judge, Family Court, Vizianagaram, need not insist the presence of the parties by virtue of Section 126(2) Cr.P.C., but for there is any specific requirement for their personal appearance.

Having regard to the above, the transfer criminal petition is disposed of.
