THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.15005 of 2025 ORDER:
This criminal petition is filed under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/accused No.6 seeking enlargement on bail in connection with Crime No.509 of of Allapur Police Station, Cyberabad Commissionerate, initially registered for the offence punishable under Section 309(4) of the BNS and later, it was altered to Section 310(2) of the BNS.

The case of the prosecution is that, along with the accused Nos.1 to 5, the CCL-1 and 2 committed theft of gold ornaments by injuring the victims. Basing on the confession of the accused Nos.1 and 2, the petitioner herein is also arrayed as accused in this case and the stolen ornaments were recovered from the possession of accused Nos.1 and 2. Basing on the same, police registered the case against the accused for the above said offences.

Heard Sri Mohd. Muzafferullah Khan, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.
The contention of learned counsel for the petitioner is that the petitioner is innocent of the said allegations and he is 19 years old intermediate student and he is falsely implicated in this case and he is in jail from 07.10.2025 and the material part of the investigation was already completed and no other cases are pending against him and he has to appear for the intermediate exams. Hence, requested this Court to grant bail to the petitioner. 5.
On the other hand, learned Additional Public Prosecutor opposed bail stating that the alleged offences against the petitioner are grievous in nature and the investigation is not yet completed. Therefore, he prayed this Court to dismiss this petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail from 07.10.2025 and as seen from the record, LWs 1 to 13
witnesses were already examined. Considering the facts and circumstances of the case and that the petitioner is an intermediate student and he has to appear for the intermediate exams and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner/accused No.6, subject to the following conditions:
i.
The petitioner/accused No.6 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned I Additional Junior Civil Judge-CumXII Additional Metropolitan Magistrate, Medchal-Malkajgiri District, at Kukatpally.
ii.
The petitioner/accused No.6 shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of
charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner/accused No.6 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
