THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1174 OF 2015 ORDER:

The petitioner has preferred the present criminal revision case by invoking the provisions under Sections 397 and 401 of Code of Criminal Procedure (Cr.P.C.,) being aggrieved by the order dated 13.02.2015 passed in Crl.M.P.No.217 of 2015, as confirmed by the order, dated 02.04.2015, passed in Crl.M.P.No.392 of 2015, by the VI Additional District and Sessions Judge-cum-Mahila Sessions Judge, Visakhapatnam, whereby the Court below directed the petitioner/accused to surrender before the Court concerned and on his surrender, he shall be enlarged on bail subject to the condition that he shall execute personal bond for a sum of Rs.10,000/- with two sureties and shall surrender his passport.

Heard and perused the material available on record. The learned trial Judge dismissed the application filed by the petitioner to release the passport on the ground that the offences are very serious in nature. The fact remains that the investigation is not completed and the charge sheet is also not filed. Learned counsel for the petitioner submitted that the petitioner is working as Supervisor/Civil Engineer in Weatherford Company, Dubai and if he continues his stay in India, he will lose his employment in Dubai, and as such, prays this Court to release the passport to the petitioner to enable him to work in Dubai. He also produced the agreement entered into between the employer and employee/petitioner to substantiate the fact that he is working in Dubai. The learned counsel for the petitioner further submitted that the petitioner is ready to appear before the Court as and when summons are issued by the Court and he is also ready to face the trial before the Court concerned.

Considering the facts and circumstances of the case and also

the above submission of the learned counsel for the petitioner, the Court below is directed to return the passport to the petitioner herein on condition of the petitioner executing a personal bond for a sum of Rs.1,00,000- (Rupees one lakh only) with two sureties to the satisfaction of the Court concerned. The petitioner is directed to inform the Court the date of leaving India and also possible date of his return t o India. The petitioner is also directed to report before the Court immediately on his arrival to India and also furnish the address of the petitioner to the Court below, to which the summons are to be served. With the above directions, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions pending in this revision, if any, shall stand closed.
