HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.33216 of 2018 ORDER:

1) Heard both sides.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in trying to allot the land admeasuring Ac.0.35 cents in Sy.No.472 of K.Bitragunta Village, Jarugumalli Mandal, Prakasam District, for construction of the masjid though the land in Sy.No.472 is classified as Donka Poramboku, as arbitrary and illegal.

3) At the time when the matter is taken up for hearing, the Government Pleader for Revenue (AP), on instructions, states that the land is classified as " Government-Poramboke-foot path" and as per G.O.Ms.No.188, PR & RD (Pts.IV) Department, dated 21.07.2011, footpath lands vests with Gram Panchayat under Category-C lands. It is further stated that the land which is classified as foot-path shall not be allotted for public purposes.

4) In view of the above, which is reflected in the written instructions placed on record, the writ petition is closed. 5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
