HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.21144 OF 2016 ORDER:

The order under challenge is suspension pending enquiry dated 24.05.2016.

The petitioner is functioning as fair price shop dealer for Shop No.47 of Indravathi Village, Uravakonda Mandal of Ananthapuram District since 2005. While so, based on the report submitted by the 3rd respondent - Tahsildar, Uravakonda Mandal, Anantapuramu, the 2nd respondent issued a show cause notice on 22.04.2016 levelling certain allegations that she is not residing in the village with her husband and her father is looking after the fair price shop, to which the petitioner submitted her explanation on 07.05.2016. Dissatisfied with the same, the 2nd respondent by order, dated 24.05.2016, suspended the authorization of the petitioner. Aggrieved by the same, the petitioner filed the present writ petition.

Learned counsel for the petitioner submitted that the petitioner has voter identity card of the village and to that effect she produced the same, which shows that the petitioner is residing in the said village. Hence, the impugned order may be suspended.

The allegation that the petitioner is not residing in the village with her husband and that her father is looking after the fair price shop is a matter to be enquired into.

Taking into consideration the fact that the petitioner had submitted voter identity card for the year 2014 of the village, there shall be a direction to the respondents to complete the enquiry and pass final orders after considering the explanation submitted by the petitioner within a period of six weeks from the date of receipt of a copy of this order by duly observing the principles of natural justice and affording an opportunity of being heard to the petitioner.

With the above direction, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any pending in the writ petition, shall stand closed.
