ORDER

This Criminal Petition is filed under Section 482 Cr.P.C. to relax the condition of executing the Bank Guarantee for Rs.53 lakhs in the order dated 13.06.2016 in Crl.M.P.No.550 of 2016 in Crime No.56 of 2016 on the file of Judicial First Class Magistrate, Pulivendula.

Heard both sides and perused the record.

Having regard to the facts and circumstances of the case, the direction of the learned Magistrate passed in the impugned order is modified to the extent of executing 'personal bond' in place of 'bank guarantee', as follows:

"...the interim custody of the petition schedule property i.e., Rs.53,00,000/- cash is ordered to be given to the interim custody of petitioner on executing a 'personal bond' for a sum of Rs.53,00,000/- with one surety to the satisfaction of the learned Magistrate concerned."

Accordingly, this Criminal Petition is disposed of. Pending miscellaneous applications, if any, shall stand closed in consequence.
