The petitioner, who was granted permission under a smart card for filling water from the reservoirs of Greater Hyderabad Municipal Corporation at Hafeezpet Filling Station for the purpose of supplying the same to the customers, filed this Writ Petition feeling aggrieved by seizure of the smart card.
From a perusal of Lr.No.GM(E)/Tankers/O&M
Dn.9/2015-16/1016, dated 31-08-2015, of respondent No.3 addressed to respondent No.2, it appears that the petitioner is alleged to have tampered electrical box seal and drawn 5 KL of water illegally from Hydernagar Filling Station, to which he was temporarily shifted and that, therefore, respondent No.3 has recommended respondent No.2 to shift the petitioner from Hydernagar Filling Station to his original Station i.e., Hafeezpet Filling Station to avoid unlawful and illegal activities.
Mr.T.Sudhakar Reddy, learned Standing Counsel for Metropolitan Water Supply & Sewerage Board, on instructions, submitted that based on the above-mentioned letter addressed by respondent No.3 to respondent No.2, an enquiry has been initiated and that the same will be completed expeditiously. He has further submitted that as per the recommendation of respondent No.3, the petitioner will be permitted to operate from Hafeezpet Filling Station, subject to the result of the enquiry, by returning the smart card.
In the light of the above facts and the submissions of the learned Counsel, the Writ Petition
is disposed of with the direction to respondent No.2 to return the smart card to the petitioner forthwith and allow him to carry on his operations from Hafeezpet Filling Station, which shall be subject to the result of the enquiry.
As a sequel to disposal of the Writ Petition, WPMP.No.45937 of 2015, filed by the petitioner for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 3rd December, 2015 LUR
