ORDER

Learned counsel for the petitioner as well as learned Public Prosecutor agreed for disposal of the case at the stage of admission. This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings and to recall the NBWs issued against the petitioner in C.C.No.491 of 2014 by the I Additional Judicial First Class Magistrate, Kadapa.

Learned counsel for the petitioner submits that a false complaint was foisted against the petitioner and he submits the same as a ground for quashing. This Court is of the view that it cannot be a valid ground.

As far as the prayer to recall NBW is concerned, the petitioner can approach the Court concerned and file a petition for the said relief and invocation of powers under Section 482 Cr.P.C are not required.

With the above observations, the Criminal Petition is disposed of.
