HON'BLE SRI JUSTICE M.S.K.JAISWAL Criminal Petition No.12893 of 2016 ORDER:

This Criminal Petition is filed by petitioner/complainant under Section 482 Cr.P.C. seeking to quash the order dated 19.08.2016, passed in CFR.No.1086 of 2016 on the file of Judicial Magistrate of First Class, Pulivendula, whereby the learned Magistrate has posted the matter to 30.09.2016 for appearance and recording the sworn statement of the complainant.

Heard and perused the material available on record. The grievance of the petitioner is that though he filed private complaint on 19.08.2016, the learned Magistrate posted the matter for his appearance and recording sworn statement of the complainant on 30.09.2016 i.e., after 40 days from the date of giving complaint, while will effect his rights and he is being deprived of his rights of enjoying the property and in the meantime, the respondents/accused are taking advantage of the Court order.

In that view of the matter, the learned Magistrate is directed to record the sworn statement of the petitioner/complainant positively on 30.09.2016, without further adjourning the matter.
