Heard learned counsel appearing for the petitioner, learned Government Pleader for Civil Supplies appearing for respondents 1 and 2 and learned Government Pleader for Revenue appearing for respondents 3 to 5.
This Writ Petition is filed seeking to declare the action of the respondents in not considering the representation dated 25.12.2014 as illegal and arbitrary.
The petitioner is the card holder of fair price shop No.6, Konathaneri Village, Thottambedu Mandal, Chittoor District. Since 2001 onwards, there was no permanent fair price shop dealer in the said village. In spite of several representations made by the petitioner and other card holders, no permanent fair price shop dealer was appointed and the fair price shop is being run only with temporary dealers, which has been causing much hardship to the card holders. Learned counsel appearing for the petitioner submitted that as the temporary fair price shop dealers resorted to committing irregularities, cases under Essential Commodities Act, have been booked against them.
Obviously, the respondents are under the obligation to appoint fair price shop dealers on permanent basis and not appointing any fair price shop dealer on permanent basis since 2001 is reprehensible.
Accordingly, the Writ Petition is disposed of at the admission stage directing the respondents to appoint fair price shop dealer on permanent basis to Konathaneri Village, Thottambedu Mandal,
Chittoor District, within a period of two months from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
