HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27392 OF 2016 ORDER:

The case of the petitioner-Educational Academy is that it was allotted land to an extent of Ac.3.85 cents (under BSO-24) in Sy.Nos.17/P, 18/P and 19/P of Vadlapudi Village, Gajuwaka Mandal, Visakhapatnam District vide proceedings dated 19.01.1983, by the 1st respondent. While allotting the said land to the petitioner certain conditions were imposed on the petitioner. Subsequently, due to efflux of time since those conditions became redundant, the petitioner submitted representation dated 21.01.2016 before the 1st respondent for waiving of those conditions and the same is pending before the 1st respondent. Aggrieved by the inaction of the 1st respondent in considering the representation of the petitioner, present writ petition is filed.

Learned counsel for the petitioner submits that the 1st respondent has ample power to waive any conditions which were made at the time of allotment of the land and prays to issue direction to the 1st respondent to consider and dispose of the representation.

Learned Assistant Government Pleader for Revenue produced written instructions stating that the earlier representation of the petitioner dated 19.11.2015 was considered and that the 1st respondent will dispose of the representation dated 21.01.2016, in accordance with law.

In view of the above, without expressing any opinion on the merits, the 1st respondent is directed to dispose of the representation

dated 21.01.2016 submitted by the petitioner, within a period of three months from the date of receipt of a copy of this order, in accordance with law.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
