THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO Transfer Civil Miscellaneous Petition No.592 of 2018 ORDER :

Heard the counsel for petitioner. None appears for respondent. 2.

This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Civil Procedure Code, 1908 seeking transfer of Divorce Original Petition No.259 of 2018 on the file of the Court of the Principal District Judge, Karimnagar, Karimnagar District to the Court of the Family Court, City Civil Court, at Hyderabad. 3.

In the affidavit filed in support of this application, petitioner contended that she is residing with her mother at Hyderabad; that the above Divorce Original Petition has been filed by respondent at Karimnagar and she has no male assistance to travel all the way from Hyderabad to Karimnagar to contest the above Divorce Original Petition; that she has custody of an infant child; and therefore, she would not be able to travel the distance of 170 kilometers from Karimnagar to Hyderabad.

Though notice in the Transfer Civil Miscellaneous Petition has been served on the counsel for respondent in the Court below, there is no representation on behalf of respondent.

Therefore, the contentions raised by petitioner stand un-refuted.

Accordingly, the Transfer Civil Miscellaneous Petition is allowed.

The Divorce Original Petition No.259 of 2018 on the file of the Court of the Principal District Judge, Karimnagar, Karimnagar District is transferred to the Court of the Family Court, City Civil Court, Hyderabad. No order as to costs.
