THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION NO.453 of 2017 ORDER :

This Criminal Petition is filed under Section 482 Cr.P.C. seeking modification of the condition imposed by the I Additional District and Sessions Judge, Visakhapatnam District in Crl.M.P.No.4296 of 2016. By an order dated 27.12.2016, passed in Crl.M.P.No.4296 of 2016 the learned I Additional District and Sessions Judge, Visakhapatnam, while releasing the petitioners on bail directed A1, A2 and A4 to furnish personal bond of Rs.50,000/ - each and two sureties each who shall each furnish a fixed deposits of Rs.50,000/ - drawn in the name of the trial Court and the same shall be produced to the satisfaction of the learned III Additional Chief Metropolitan Magistrate, Visakhapatnam at Gajuwaka. A3 was directed to furnish personal bond of Rs.1 lakh and two sureties who shall each furnish a fixed deposit of Rs.

1 lakh drawn in the name of the trial Court and the same shall be submitted to the satisfaction of the learned III Additional Chief Metropolitan Magistrate, Visakhapatnam at Gajuwaka. The counsel for the petitioners submits that the petitioners are labourers and it is difficult for them to furnish surety amount. Having regard to the facts and circumstances of the case, the condition of A1, A2 and A4 furnishing personal bond of Rs.50,000/ - each and two sureties each who shall each furnish fixed deposits of Rs.50,000/ - and the condition of A3 furnishing personal bond of Rs.1 lakh and two sureties each who shall each furnish fixed deposits of Rs.1 lakh drawn in the name of the trial Court is modified as under: " A1, A2 and A4 shall furnish personal bond of Rs.

each who shall each furnish a fixed deposit of Rs.25,000/ - drawn in the name of trial Court and shall produce the same to the satisfaction of III Additional Chief Metropolitan Magistrate, Visakhapatnam at Gajuwaka. A3 shall furnish personal bond of Rs.1 lakh (Rupees one lakh only) with two local sureties for a likesum each who shall each furnish a fixed deposit of Rs.1 lakh drawn in the name of trial Court and shall produce the same to the satisfaction of III Additional Chief Metropolitan Magistrate, Visakhapatnam at Gajuwaka" .
