2017-03-28A.Rajasheker Reddy1 pages

THE HON'BLE SRI JUSTI CE A.RAJASHEKER REDDY W .P.NO.8 4 0 6 OF 2 0 1 7

O R D E R

The claim of the petitioner is that she has been in possession of the subject land, which was regularized vide proceedings of the 2nd respondent - Tahsildar in B/ 1042/ 2015 and B/ 327/ 2015 dated 29.5.2015. Aggrieved by the action of the respondents in seeking to dispossess her from the subject land, by dismantling the structures, without following the due process of law, the present writ petition has been filed.

This court by interim order dated 15.3.2017 directed the parties to maintain status quo for a limited period.

The learned Assistant Government Pleader for Revenue submits that since the subject land has been regularized based on misleading facts of the petitioner, action has been initiated.

In view of the above facts and circumstance and the submissions of the learned counsel, without expressing any opinion on merits, the writ petition is disposed of at the stage of admission, directing the authorities to take appropriate action after following the due process of law. Till then the interim order of status quo granted by this court on 15.3.2017, shall continue. No costs.

Miscellaneous petitions pending if any, shall stand closed. ----------------------------------------- A.RAJASHEKER REDDY,J DATE: 28-03-2017 AVS
