The only grievance of the petitioners in this Writ Petition is that respondent No.2 has not been considering their applications, dated 21-01-2015 and 11-10-2015, for mutation of their names in the municipal records in respect of property bearing No.820, Ganesh Nagar, Guddalur, Prakasam District, in pursuance of family settlement deed, dated 21-012002. At the hearing, Mr.Nimmagadda Venkateswarlu, learned Standing Counsel for respondent No.2Municipality, on instructions, submitted that as the family settlement deed, based on which the petitioners are claiming mutation, is an unregistered one, respondent No.2 has not considered their application.

In my opinion, it is incumbent upon respondent No.2 to dispose of the petitioners' application for mutation in accordance with law. If it finds that the application is defective or that the claim made by the applicants suffers from any legal infirmity, it has to return/reject such application by passing a speaking

order and communicate the same to the applicants to enable the latter either to remove the defects and represent the same or to avail further legal remedies. In this view of the matter, respondent No.2 is directed to dispose of the petitioners'

applications in accordance with law and communicate its decision to them within two weeks from the date of receipt of this order.

Subject to the above direction, the Writ Petition is disposed of.

As a sequel to disposal of the Writ Petition, WPMP.No.52528 of 2015, filed by the petitioners for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 16th December, 2015 lur
