THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.35521 of 2015 ORDER:

The grievance of the petitioner is that the Station House Officer, Chandrayangutta Police Station, Hyderabad, was harassing her by calling her to the police station and forcing her to enter into a compromise with third parties in respect of a property which was the subject-matter of a civil litigation.

The Station House Officer, Chandrayangutta Police Station, Hyderabad, filed a counter-affidavit categorically denying that he had ever called the petitioner to the police station for any purpose. He further stated that he was unaware of the petitioner's properties. According to him, no complaint had been received and no case was registered against the petitioner on the file of Chandrayangutta Police Station, warranting his interference with her life and liberty. He adverted to the fact that the petitioner's brother, Zeeshan Ahmed, was shown as an accused in Crime No.283 of 2015 which had been registered on the file of Chandrayangutta Police Station, Hyderabad, under Sections 448, 504 and 506 I.P.C. read with Section 25(1)(a) of the Arms Act, 1959. He however stated that this case had nothing to do with the land dispute of the petitioner and that he had never interfered in any such civil dispute.

The petitioner filed a reply affidavit reiterating her allegation that the Station House Officer, Chandrayangutta Police Station, Hyderabad, was harassing her. She further alleged that the Station House Officer had filed a false affidavit to save himself. Sri Mohd. Adnan, learned counsel for the petitioner, fairly concedes that there is no material available with the petitioner to substantiate her allegation that the Station House Officer, Chandrayangutta Police Station, was interfering in her civil disputes and harassing her.

In view of the unequivocal denial by the Station House Officer,

which is duly taken on record, this Court is of the opinion that no adjudication is warranted on merits in this case. In the light of the clear stand and undertaking given by the Station House Officer, Chandrayangutta Police Station, Hyderabad, to the effect that he did not call the petitioner to the police station or harass her to settle a civil dispute in relation to a particular land which was the subject matter of O.S.No.2530 of 2015 on the file of the learned XX Junior Civil Judge, City Civil Court, Hyderabad, the writ petition is closed.

In the event the Station House Officer, Chandrayangutta Police Station, Hyderabad, commits any breach of the undertaking given to this Court, it would be open to the petitioner to invoke the contempt jurisdiction of this Court.

The Station House Officer, Chandrayangutta Police Station, Hyderabad, would therefore be mindful of this aspect. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
