HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.17779 OF 2017 ORDER:

This writ petition is filed by the petitioners seeking a direction to the respondents to extend the lease period for a further period of one year i.e., 2017-2018 in respect of the land admeasuring Ac.14.00 cents in Sy.Nos.883/A situated in Kopparam of S. Maguluru Mandal, Prakasam District in terms of G.O.Ms.No.2, dated 14.2.2017. 2.

It is the case of the petitioners that they were the highest bidders in the auction conducted by respondents Nos.3 & 4 in the year 2014 in respect of the lands in question and each petitioner got lease of Ac.4.70 cents. For the last three years, the petitioners have been cultivating the above lands. For the year, 2016, the State of Andhra Pradesh issued a notification declaring certain Mandals as drought hit Mandals and S. Maguluru Mandal was also declared as drought hit Mandal as per G.O.Ms.No.2 Revenue (D.M.II) Department, 14.2.2017. While so, on 5.4.2017, it is intimated that the lease period of the petitioners was expired by the end of 2016-2017 and that the respondents are going to auction the lease hold rights in respect of the above lands. The petitioners orally requested the respondents to extend the lease period for one year on the same lease amount as provided in the Act. But the respondents expressed their inability. Hence, the petitioners filed this writ petition. 3.

Heard and perused the material available on record. 4.

Considering the facts and circumstances of the case and the submissions made by both the Counsel, without expressing any opinion on merits, this Court is inclined to pass the following order:

"The petitioners are directed to make a representation before the respondents concerned for extension of lease period for a period of one year in respect of the lands in question, on the basis of the above G,O.Ms.No.2, dated 14.2.2017. On such representation being made, the respondents concerned are directed to extend the lease period for another one year." 5.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, Miscellaneous petitions pending, if any, shall stand closed. _________________ JUSTICE RAJA ELANGO Dated: 6th June, 2017 Nn.
