THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CIVIL REVISION PETITION No.3820 OF 2016 ORDER:

This Civil Revision Petition is filed by the petitioner alleging that the learned Family Court Judge, Nellore is not receiving the application filed by the petitioner in F.C.O.P.No.198 of 2015 seeking to order substitute service of notice to the respondent as the respondent is deliberately evading to receive the notice. Heard the learned counsel for the petitioner. In the present civil revision petition notice before admission was ordered on 19.08.2016 while permitting the petitioner to take out personal notice. Memo filed by the petitioner stating that two addresses to which the notices sent were returned one with endorsement that the addressee had left without instructions and hence returned to sender and second one received with endorsement that the addressee refused to take notices and hence returned to sender with endorsement.

Prima facie, the material placed before this Court discloses that the respondent is evading the receipt of the notices. In those circumstances, the Civil Revision Petition is allowed with a direction to the Court below to receive the Interlocutory Application for substituting the service and process the same in accordance with the law.

Subject to the above, the Civil Revision Petition is allowed. There shall be no order as to costs. Miscellaneous Petitions, if any pending in this revision, shall stand closed. _____________________________ CHALLA KODANDA RAM,J Date:03.11.2016.
