THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14926 of 2025 ORDER:

This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/A.2 seeking his enlargement on bail in connection with P.R.C.No.04 of 2020 in Crime No.649 of 2019 of Mailardevpally Police Station, wherein the petitioner was remanded to judicial custody on execution of NBW issued by the Court on 13.04.2023.

Heard Sri M.M.Ahmed Khan, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 3.

The contention of learned counsel for the petitioner is that no summons was received by the petitioner in the said case due to which he has not appeared before the trial Court. The petitioner filed bail application before the trial Court, but the same was dismissed. Petitioner undertakes to cooperate with

the trial Court. Hence, prayed this Court to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail stating that petitioner was absconding and with great difficulty he was produced before the trial Court. If bail is granted he will not cooperate with the trial. The P.R.C is pending from the year 2020 because of his non-appearance before the trial Court. Hence, prayed to dismiss this petition. 5.

Considering the submissions made and the material on record, the offence alleged against the petitioner is under Section 307 r/w.34 of IPC which was registered in the year 2019 and P.R.C, was numbered in the year 2020 and petitioner has not appeared before the trial Court from 2023, as such, NBW was issued against him. Considering the submission of petitioner that no summons was received by him and in view of his undertaking that he will cooperate with the trial, the petitioner is granted bail subject to the following conditions : i.

The petitioner/A.2 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of X-Additional District &

Sessions Judge, Ranga Reddy District at L.B.Nagar.

ii.

The petitioner/A.2 shall appear before the trial Court on every date of hearing as directed by the trial Court.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending, shall stand closed.
