HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition Nos. 28207 and 28252 of 2016 Common Order:
These two Writ Petitions are being disposed of by this common order as the petitioners in both the Writ Petitions are working in the third respondent - Primary Agricultural Cooperative Society.
2. The petitioners filed the present Writ Petitions challenging their retirement at the age of 58 years without treating them on par with the employees of the State Government and by virtue of the amendment made to the AP Public Employment (Regulation of Age of Superannuation) Act, 1984.
3. This Court, by a detailed order in WPMP No.25338 of 2016 in WP No.20673 of 2016, dated 29.06.2016, directed the respondents Cooperative Societies to take a decision with regard to age of superannuation taking into consideration the provisions of Section 115-D(2)(iv) of the AP Cooperative Societies Act, 1964 and also the Memos of the Government issued from time to time, within a period of four weeks from the date of passing the said order. The petitioners who were in service were directed to be allowed to continue in service till 31.07.2016.
4. Now, the learned counsel for the third respondent submits that the Primary Agricultural Cooperative Societies have taken a decision to retire their employees on completion of 58 years and they want to utilise the services of the retired employees on separate terms whenever there is a need.
5. In view of the same, these two Writ Petitions are dismissed giving liberty to the third respondent to engage the services of the petitioners on separate terms, if the third respondent so desires. There shall be no order as to costs.
6. As a sequel thereto, the miscellaneous applications, if any, pending in these Writ Petitions shall stand closed. ________________________ A.
