Heard.

One Jayaramireddy, who is the father of petitioners 1, 2 and 4, fatherin-law of the 3rd petitioner and the husband of the 5th petitioner, purchased the land admeasuring Ac.4-00 cents in Sy.No.632/1 vide Sale Certificate in E.P.No.66/79-80. He is also stated to have purchased the land admeasuring Ac.4-00 cents in Sy.No.632/2 vide Sale Certificate in E.P.No.65/79-80. Similarly, the land admeasuring Ac.4-00 cents in Sy.No.632/3 was also purchased by him vide Sale Certificate in E.P.No.64/79-80. One Manunuru Chinna Venkata Reddy purchased the land admeasuring Ac.4-00 cents in Sy.No.632/4 vide Sale Certificate in E.P.No.67/79-80 and the 4th petitioner purchased the said land from the said Manunuru Chinna Venkata Reddy vide registered sale deed, dated 17-02-1987.

In addition to that, the 5th petitioner, who is the wife of Jayaramireddy is stated to have purchased the land admeasuring Ac.1-45 cents in Sy.No.279 from one Chiyyavaram Chenchureddy and others under registered sale deed, dated 12-02-1979. Thus, the petitioners claim title and possession over the aforesaid lands. All the said lands are proposed to be sold by the petitioners to the purchaser, but on presentation of the same, the 2nd respondent is stated to have refused to register the same without expressing any reason. The petitioners had earlier approached this Court in W.P.No.15536 of 2015 but their proposed sale is not disclosed and no orders were passed in the said writ petition. The petitioners now disclosed the proposed sale in paragraph '8' of the affidavit in the present writ petition.

The earlier writ petition was dismissed as withdrawn with a liberty to file the present writ petition. The petitioners have also produced copy of the agreement of sale, dated 30-04-2015 entered with the prospective purchaser.

the document presented by the petitioners for registration. The issue raised in this writ petition is squarely covered by the judgment of this Court in W.P.No.16909 of 2015, dated 15-06-2015. In view of the same, following the aforesaid judgment, this writ petition is also disposed of directing the 2nd respondent to receive and process the document presented by the petitioners for registration in relation to the subject property. In the event the 3rd respondent is of the opinion that the document warrants refusal of registration, he shall pass appropriate orders duly recording the reasons for such refusal in accordance with Section 71 of the Act. If, however, the document is found to be complied with all legal requirements, he shall register the same and release it in accordance with due procedure. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
