HON'BLE SRI JUSTI CE C. PRAVEEN KUMAR WRIT PETITION No. 33430 of 2018 ORDER:
1) Heard Sri V.Eswaraiah Chowdary, learned counsel for the petitioners and Sri Pasham Krishna Reddy, Standing Counsel for respondents 2 and 3. With the consent of both the parties, the writ petition is heard at the admission stage itself.
2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondents 2 and 3 in not considering the application dated 14.07.2018 submitted by the petitioners along with plans in respect of the house bearing No.19-4-279/ 4/ 8/ 1 to 4 in plot Nos.3 and 5 situated at Meersagar, Tadbun, Hyderabad, despite the petitioners paid the requisite fee of Rs.10,000/ - each on 17.07.2017 as arbitrary, illegal, without jurisdiction and violative of principles of natural justice. 3) Learned Standing Counsel for the respondents 2 and 3 would submit that the appropriate authority to consider the applications of the petitioners is Assistant Commissioner and not the Zonal Commissioner, but however the learned counsel for the petitioners would submit that the appropriate authority is Zonal Commissioner only.
4) Having regard to the above, if the Zonal Commissioner is otherwise competent and is having jurisdiction to deal with the applications submitted by the petitioners seeking building permission, he shall deal with the same in accordance with law, at an earliest.
5) With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
