THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.192 of 2015 ORDER:
Heard both sides and perused the order passed by the trial Court in Crl.M.P.No.57 of 2014 in S.C.No.316 of 2013. I find no illegality or irregularity in the order of the Trial Court to interfere with, when it is found to be correct. Now, learned counsel for petitioner requests that he may be permitted to engage an Advocate of his choice to assist the prosecution as laid down under the proviso to Section 24(8) Cr.P.C. and Section 301(2) Cr.P.C. Considering his request, while dismissing the Criminal Petition, a liberty is given to the petitioner/ defacto complainant to file a petition before the trial Court seeking permission to engage an Advocate of her choice to assist the Additional Public Prosecutor in terms of proviso to Section 24(8) Cr.P.C. and Section 301(2) Cr.P.C. and the trial Court shall pass an appropriate order thereon.
As a sequel, the miscellaneous petitions, if any, pending shall stand closed.
