HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.31614 OF 2016 ORDER:

The petitioners are challenging the provisional certificate of registration of Fresh Water Aquaculture Farm vide Ref.No.FW(NFP)/EG/ALVRM-3972, dated 15.07.2016 granted to the 6th respondent.

Learned counsel for the petitioners submits that the provisional registration has been granted in respect of fertile land and the same may cause obstruction to the irrigation channel which provides water to the lands of the petitioners and that he seeks to suspension of the said provisional certificate registration. He also submits that respondent No.6, who was granted the said registration obtained the same by suppressing the facts.

Heard learned Government Pleader for Fisheries. Admittedly, granting of provisional certificate registration in favour of 6th respondent is covered under the provisions of G.O.Ms.No.7, dated 16.03.2013. But, Clause -F of the guidelines annexed to the said G.O. empowers the Commissioner of Fisheries to order for cancellation of registrations, imposition of penalties, the closure of operations and demolitions. By virtue of the said clause, it is open for the petitioners to make complaint to the

Commissioner, Fisheries as per Clause-F of the guidelines provided in G.O.Ms.No.7, dated 16.03.2013. In view of the same, since petitioner has alternative remedy, I am not inclined to entertain the writ petition.

Accordingly, the writ petition is dismissed. However it is open for the petitioners to approach the Commissioner, Fisheries by filing a complaint against the said provisional certificate registration and on such complaint being filed, the Commissioner, Fisheries is to consider the same and pass orders in accordance with law. No order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 22.09.2016 tk
