HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 35130 of 2016 ORDER:

1) Heard learned counsel for the petitioner and Government Pleader for Revenue. With consent of both the parties, the writ petition is being taken up at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of the third respondent in de-notifying the land admeasuring Ac.0.72 cents in Sy.No.2388 of Moolasagaram Village, Nandyal Mandal, Kurnool District, as illegal, arbitrary, un-constitutional and against the principles of natural justice; consequently direct the fourth respondent to receive and register the sale deed filed by the petitioner in respect of the said property, without reference to the letter dated 14.04.2016.

3) Though various grounds are raised in the writ petition, learned counsel for the petitioner submits that his representation made to the District Collector, Kurnool, for deletion of the said property may be directed to be considered by taking into consideration the reports of the Tahsildar.

4) The Government Pleader for Revenue submits that he has no objection for the same, provided, if such an application is still pending.

5) Recording the submissions, the present writ petition is disposed of, directing the District Collector, Kurnool, to deal with

the representation, if any, made by the petitioner seeking deletion of the land in Sy.No.2388 from the prohibitory list, after taking into consideration all the material filed by the petitioner and after hearing the petitioner, in accordance with law, as early as possible, preferably, within a period of six to eight weeks from the date of receipt of a copy of the order. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _________________________ JUSTICE C.
