HONOURABLE SRI JUSTICE P. NAVEEN RAO Writ Petition No.14098 of 2017 ORDER :

The petitioner is a soldier in Army under the control of the 3rd respondent.

This Writ Petition is instituted alleging that respondents are not giving the Movement Order, Clearance Certificate and Identity Card to the petitioner enabling him to join at the new place. 3.

The petitioner being part of the armed forces, if he has any grievance, he should invoke the jurisdiction of the Armed Forces Tribunal established under the Armed Forces Tribunal Act, 2007 and such Tribunal being the Court of first instance, this Court do not entertain the present Writ Petition. 4.

The Writ Petition is accordingly dismissed. However, it is open for the petitioner to avail the remedy available under the Armed Forces Tribunal Act, 2007. There shall be no order as to costs. 5.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
