THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.5220_OF 2016 ORDER:

Heard the learned counsel for the petitioners and the learned Public Prosecutor.

2. The present Criminal Petition came to be filed by the petitioners/A.5, A.12 to A.14 under Section 439(1)(b) read with 482 Cr.P.C., seeking relaxation of conditions imposed in Crl.M.P.No.230 of 2016 in Crime No.21 of 2016 of T.Sundupalli Police Station, Kadapa District by the learned V Additional Sessions Judge, Rayachoty.

3. By an order dated 16.03.2016 while granting bail to the petitioners, learned V Additional Sessions Judge, Rayachoty, directed the petitioners to execute a self bond for Rs.50,000/- each with two local sureties for the like sum each supported by the original sale deeds to the satisfaction of learned Additional Judicial Magistrate of First Class, Rayachoty.

4. Learned counsel for the petitioners mainly submits that all the petitioners are residents of Tamilnadu State and that it is difficult for them to get two local sureties. He further submits that though the order was passed on 16.03.2016 till date the petitioners could not be released.

5. Learned Public Prosecutor opposed the same contending that if the condition of furnishing local sureties is relaxed, it would be very difficult to secure the presence of the petitioners.

6. Having regard to the fact that the petitioners could not be released though the bail was granted on 16.03.2016, the request of the petitioners can be considered by modifying the impugned order.

7. Accordingly, the Criminal Petition is allowed in part and the petitioners shall execute a personal bond for a sum of Rs.25,000/- each with two local sureties for a like sum each supported by the original sale deeds to the satisfaction of learned Additional Judicial Magistrate of First Class, Rayachoty, Kadapa District.
