This writ petition is filed challenging the superannuation proceedings issued by respondents 2 and 3.

Though counter affidavit and vacate stay petition were filed, learned counsel for the petitioner as well as Sri Nandigama Krishna Rao, learned Standing Counsel for respondent-Singareni Collieries Company Limited submitted that the writ petition can be disposed of with a direction to the respondent-authorities to treat the date of retirement of the petitioner as 31-08-2013 to pay retirement benefits. In view of the same, the writ petition is disposed of directing the respondent-authorities to pay retirement benefits to the petitioner by treating his age of superannuation as 31-08-2013 within a period of four weeks from the date of receipt of a copy of this order.
