HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.33278 OF 2018 ORDER:

Aggrieved by the action of the 2nd respondent in filing the recovery petition against the petitioner in Cr.M.P.No.3094 of 2017 in CF No.3415 of 2017, dated 28.07.2017, this Writ Petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Labour appearing for respondents 1 & 2.

Admittedly, petitioner has alternate remedy of Appeal under Section 53 of the Andhra Pradesh Shops & Establishments Act, 1988, as such, this Court is not inclined to entertain the Writ Petition.

In view of the same, this Writ Petition is disposed of granting liberty to the petitioner to avail alternate remedy of Appeal under Section 53 of the A.P.Shops & Establishments Act, 1988, if he is so advised. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, shall stand closed.
