ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioners/A1 and A2 seeking to quash the proceedings in Cr.No.499 of 2016 of Narsingi Police Station, Cyberabad District, registered for the offences punishable under Sections 365, 506, 109 read with Section 34 IPC and under Section 3(1)(r)(s) of SCs & STs (POA) Act, 1989, against them.

Heard learned counsel for the petitioners/A1 and A2 and learned Additional Public Prosecutor representing the State.

The second respondent, who was working as Assistant Professor on contract basis in Chaitanya Bharathi Institute of Technology, Hyderabad, lodged a complaint with the police that on 10.09.2016 at about 1730 hours, Dr. Radhika, Head of the Department, took him to the Principal's room, wherein the Principal and B. Srinivas Reddy of physical department all of sudden held him tightly, pushed him forcibly into black colour car, then four unknown persons kidnapped him in a car, took him to Khanapur side and threatened him with dire consequences on the ground that he belongs to SC community and his services cannot be regularized. Based on the complaint, the aforesaid crime was registered.

4. Learned counsel for the petitioners prayed the Court to grant stay of arrest of petitioners.

5. There is no dispute that the police after due investigation registered the case against the petitioners. In view of the allegations in the complaint, this Court cannot interfere with the investigation. However, considering the facts and circumstances of the case, the petitioners are directed to surrender before the Special Court concerned and move an application for bail and on filing such an application, the Special Court is directed to grant bail to the petitioners with certain conditions on the same day or next day. 6.

With the above direction, the Criminal Petition is disposed of. Miscellaneous applications, if any, pending in this criminal petition shall stand closed.
